case FIR No.11 dated 25.01.2015 registered at Police Station City Rajpura, District Patiala under Sections 382/411 IPC, are that on 25.01.2015 in the area of Police Station City Rajpura accused petitioner Kiratpal was driving a motorcycle on which remaining two accused Mahinder Singh alias Monu and Sikander Singh were pillion riders and had snatched mobile phone set of the complainant Sandeep Kumar.

Learned counsel for the petitioners Mr. Rakesh Gupta, Advocate; Ms. Gurnam Kaur Turka, Advocate and Mr. Gursimran Singh, Advocate have submitted that the petitioners were not apprehended at the spot and were subsequently apprehended on 28.01.2015 and are in custody since then.

Though the bail application is stoutly opposed by learned State counsel, however, keeping in view the fact that the petitioners have already undergone incarceration for a period of around 7 months and the fact that investigation and trial will take a long time to conclude and the culpability, if any, shall be determined at the time of trial, this Court without going into the merits of the case, is of the opinion that no useful purpose will be served by keeping the petitioners behind bars in the present case. Accordingly, all the three petitioners are ordered to be released on regular bail to the satisfaction of trial Court.
