HARINDER SINGH SIDHU, J Present petition has been filed under Section 439 of the Code of Criminal Procedure (Cr.P.C.) for grant of concession of regular bail to the petitioner in case FIR No.52 dated 27.04.2021 registered under Sections 15, 25, 29, 61 of the NDPS Act, 1985 at Police Station Dhanaula, District Barnala.

The case was registered on secret information that the petitioner along with co-accused Inderjit Singh, Kanwaljit Singh @ Kamal and Jaspal Singh were involved in the selling of poppy husk. A Naka was laid and three cars were intercepted i.e. Verna Car, I-10 Car and Toyota Etios car. From the Verna Car, six bags of poppy husk weighing 25 kg. each were recovered. The occupant of the car, namely, Kanwaljit Singh was arrested. From the I-10 car one bag of poppy husk weighing 25 kg. was recovered. The occupants of this car, namely, Inderjit Singh and Gurjeet Singh, were arrested. The Toyota Etios Car was driven by Jaspal Singh (petitioner) who was its owner and the co-passenger was Manjinder Singh. One bag containing 25 kg. poppy husk was recovered. CRM-M-27586 of 2021 #2# Learned counsel states that the recovery from the petitioner is non-commercial. The petitioner has clean antecedents. He is not involved in any other criminal case. He cannot be said to be in conscious possession of the poppy husk recovered from the other cars. The petitioner is in custody since 27.04.2021. The investigation of the case is complete. In view of the above and keeping in mind the fact that the investigation of the case is complete and petitioner is in custody since 24.04.2021, no useful purpose would be served by keeping him behind the bars. Hence, petition is allowed. Petitioner - Jaspal Singh is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/ Duty Magistrate concerned.
