Prayer made in the present petition is for quashing the order dated 22.07.2004, whereby the claim of the petitioners for grant of rural area allowance was rejected.

Learned State counsel makes a reference to paras 4 and 5 of the written statement dated 23.11.2005 filed by respondent Nos.1 to 5, wherein it has been specifically stated that it was on account of misinterpretation of orders dated 29.06.2001 and 22.08.2001 which remained in operation for about 2 months i.e. July and August 2001 only. However, on coming to know of the same, these instructions were withdrawn on 21.09.2001 and the claim of the petitioners was rightly rejected. The petitioners are getting their salaries with all allowances at the rate admissible to them, thus their claim is not covered under the relevant instructions. To the above facts, there was no rebuttal by filing any replication.

In view of the above, the present petition is disposed of, reserving the petitioners with a liberty to get it revived, in case lis still subsists.
