The petitioner has been in custody for the last more than two years for being in possession of 10 bags of poppy husk, weighing approximately 39 kgs each.

On asking of the court, learned State counsel informs that out of 7 witnesses, only 3 witnesses have been examined. Prima facie the identity of the petitioner appears to be a debatable issue. Besides this the petitioner has not been arrested from the spot. Without expression of any opinion on merits of the case, at this stage, it is deemed appropriate to dispose of this petition with a direction to the trial court to make an earnest endeavour to conclude the trial within a period of six months from the next date of hearing fixed before the trial court. In case the trial is not concluded within the above said period, the trial court shall release the petitioner on bail on his furnishing bail bonds/ surety bonds to its satisfaction. The prosecution agency is directed to expeditiously examine the prosecution witnesses by producing them before the court on the short dates given by the trial court.
