Present:

Mr. Brijesh Nandan, Advocate for the petitioner(s).

The petitioner prays for grant of regular bail pending trial in a criminal case arising from FIR No. 90 dated 22.04.2019, registered under Section 379-B IPC, at Police Station City Tarn Taran, District Tarn Taran. As per the case of the prosecution, the victim alongwith another was travelling in a hired auto when two boys, riding on a motorcycle, snatched her handbag. The victim, with the help of a stranger, who was going in a motor car, successfully chased and nabbed the petitioner. Ms. Samina Dhir, Deputy Advocate General, Punjab has disclosed that the petitioner is a habitual offender and involved in as many as four more such cases. On completion of the investigation, the challan has been submitted in the court and the charges have been framed. The case is now fixed for prosecution evidence. It has also been disclosed that the next date before the trial court is 23.11.2020.

Keeping in view the facts of the case, this Court is not inclined to grant regular bail to the petitioner and the same is dismissed. However, the trial Court is requested to ensure that the statement of the victim is recorded either on the next date of hearing or within a short time thereafter. Needless to observe that after the statement of the victim is recorded, the DEEPAK KUMAR BHARDWAJ 2020.11.02 12:57 I attest to the accuracy and integrity of this document

Criminal Misc. No. M- 23502 of 2020 petitioner, if so advised, would be at liberty to file an application for grant of regular bail.
