The matter has been taken up through video conferencing in the light of COVID-19 pandemic.

The present petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction in the nature of certiorari for quashing the order dated 01.07.2020 and further to release the petitioner on parole for six weeks. In these proceedings, learned State counsel has filed reply by way of affidavit of Superintendent, Cental Jail, Ferozepur, on behalf of respondents No.1 to 3 and annexures appended thereto, which would clearly VINEET GULATI 2020.09.24 14:53 I attest to the accuracy and authenticity of this document Chandigarh

CRWP No.6043 of 2020 -2indicate that the petitioner is involved in five other cases as mentioned in the aforesaid affidavit and further, in an earlier proceeding, while petitioner was in custody, his prayer for parole was considered in the year 2010 and he was released on parole on 16.07.2010. However, it is stated that the petitioner herein jumped his parole and absconded from parole for the period dated 14.08.2010 to 20.07.2013 i.e. for a period of 2 years 11 months and 6 days and he surrendered back on 21.07.2013. With the aforesaid facts, we are of the considered view that the order of respondents in rejecting the prayer for grant of parole to the petitioner appears to be just and proper. Therefore, question of considering the present petition for grant of parole does not arise. Accordingly, the present petition is hereby dismissed.
