(ORAL) In pursuance of the request made by the petitioner, as recorded in the order dated 25.03.2019 to the effect that letter (Annexure P-1), attached with the writ petition, be treated as a resignation from service and the same be accepted as such rather than terminating the services of the petitioner on the ground of absence from duty. Today, learned State counsel has produced an order dated 28.03.2019, according to which, the resignation of the petitioner has been accepted w.e.f. 22.03.2004 i.e. on completion of three months after the submission of the resignation letter (Annexure P-1). Further, all the proceedings, which were initiated against the petitioner for remaining absence, have been dropped in view of the acceptance of the resignation. CWP-8846-2005 (O&M) -2Learned State counsel, on instructions from Sh. Harwinder Singh, Senior Assistant, states that as the notice has been accepted after a period of three months, there is no requirement of depositing of three months' salary as envisaged in the said order. Counsel for the petitioner states that in view of the passing of the order dated 28.03.2019, he does not want to press this writ petition any further and the same may be disposed of as having being rendered infructuous.

Disposed of, as having being rendered infructuous. Keeping in view the order passed in the main writ petition, CM-1844-CWP-2017 has been rendered infructuous and the same is also disposed of as such.
