The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.604 dated 31.12.2024 (Annexure P-1) registered under Sections 419, 420, 467, 468, 471 and 120-B of IPC at Police Station City Palwal, District Palwal. 2.

As per the allegations leveled against the petitioner, a conveyance deed and an authority letter were forged. The conveyance deed was executed by Amit as the presenter and Bandhan Bir Singh as the purchaser in collusion with Arjun Namberdar and Moolchand. In the authority letter, Amit was shown as the authorised person from the office of Tehsildar (Sales) Faridabad. During the investigation, it transpired that Babli appeared as Amit and Lalit (petitioner) appeared as Bandhan Bir Singh.

CRM-M-21303-2025 -2Later, the property was transferred in the name of Madhu Bala, wife of Lalit (petitioner). Subsequently, the property was sold to Pankaj Gandhi. 3.

The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. In fact, he is a victim of a conspiracy hatched by the other accused. Taking the allegations to be correct, he has impersonated himself as a Bandhan Bir Singh. As the investigation stands concluded, he is in custody since 13.12.2024 but only 04 of the 12 prosecution witnesses have been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

On the other hand, the learned State counsel has filed an affidavit dated 30.10.2025, which is taken on record. While referring to the same, he contends that the petitioner impersonated as Bandhan Bir Singh and is one of the main accused. The nature of the allegations levelled against him does not entitle him to the concession of bail. He, however concedes that the petitioner is in custody since 13.12.2024 and that only 04 of the 12 prosecution witnesses have been examined so far. 4.

I have heard the learned counsel for the parties. 5.

The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. He is in custody since 13.12.2024 but only 04 of the 12 prosecution witnesses have been examined so far. Therefore, the Trial of the present case is not likely to

CRM-M-21303-2025 -3be concluded anytime soon. In this situation the further incarceration of the petitioner is not required.

Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Lalit S/o late Sh. Om Parkash is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.

The petitioner (or anyone on his behalf) shall prepare an FDR in the sum of Rs.50,000/- and deposit the same with the Trial Court. The same would be liable to be forfeited as per law in case of the absence of the petitioner from trial without sufficient cause. 8.

The petition stands disposed of.
