(ORAL) The petitioner herein seeks the relief of the issuance of a writ in the nature of mandamus directing respondents No.2 and 3 to protect his as well as his family members' lives and liberty as they apprehend threat to the same at the hands of respondents No.4 to 9 and also to take legal action on the representation (Annexure P-3) as moved by him. The averments, in brief, as made by the petitioner in this petition, are that due to some financial dispute between him and respondent No.6, the said respondent has got a false case registered by his daughter, i.e. respondent No.5, against him and respondent No.4 has also preferred a complaint against him to the S.H.O., Police Station Tanda. He (petitioner) was called at the police station in connection therewith and was given beatings. He has already moved the said representation against respondents No.8 and 9 to the D.I.G., Jalandhar Range, Jalandhar, in this NEETU RANI 2021.07.20 16:10 I attest to the accuracy and integrity of this document PHHC

Concededly, a criminal case already stands registered against the petitioner at the instance of respondent No.5 and respondent No.4 has also moved a complaint to the police against him. It being so, the concerned police authorities are supposed to look into the allegations levelled against him therein. In these circumstances, the petitioner cannot choose the mode and the Investigating/Enquiring Agency for looking into the allegations levelled against him.

As regards the prayer of the petitioner qua taking legal action on the said representation (Annexure P-3) moved by him to the D.I.G. with the request to place respondents No.8 and 9 under suspension and/or not to allow them to participate in the enquiry qua the said complaint as moved against him, no such direction by this Court is warranted as it will amount to interference in the administrative functions of the Department. As a sequel to the fore-going discussion, it follows that this petition, being sans any merit, deserves dismissal. Resultantly, the same stands dismissed accordingly.
