(Oral) Present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.249 dated 17.07.2009, under Sections 498-A, 406, 506 and 34 IPC, registered at Police Station Sohna, District Gurgaon and all other consequential proceedings arising therefrom on the basis of compromise/affidavits (Annexures P-2 and P-3). Vide order dated 11.08.2016, the trial Court was directed to record the statements of all the concerned parties, with regard to the genuineness and validity or otherwise of the compromise/affidavits (Annexures P-2 and P-3).

As per report of learned Judicial Magistrate 1st Class, Sohna, Naresh Kumar 2017.03.29 16:08 I attest to the accuracy and integrity of this document Chandigarh dated 23.03.2017, complainant has not come forward to make the statement.

Keeping in view the above-said report and the fact that sufficient opportunities have already been granted to the parties to record the statement, vide orders dated 11.08.2016, 21.10.2016 and 30.01.2017, no option is left with this Court except to dismiss the present petition for non-prosecution and accordingly, the same is hereby dismissed as such.
