This is a petition for anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in case bearing FIR No.105 dated 24.08.2023 under Sections 21(1) and 4(1) of Mines and Minerals (Regulation of Development) Act, 1957 registered at Police Station Sri Anandpur Sahib, District Rupnagar.

This Court, vide order dated 28.04.2025, had directed the petitioner to appear before the SHO/Investigating Officer and join investigation and in the event of her arrest, she was ordered to be released on ad-interim bail to the satisfaction of the SHO/Investigating Agency, subject to the conditions envisaged under Section 482(2) of the BNSS (erstwhile Section 438(2) Cr.P.C.) 3.

Learned counsel for the petitioner submits that in compliance of the order dated 28.04.2025 passed by this Court, the petitioner has joined and cooperated with the investigation.

Learned State counsel states that the petitioner has joined the

CRM-M-20949-2025 investigation and is not required for custodial interrogation. 5.

In view of the statement made by learned State counsel, the petition is allowed and the interim order dated 28.04.2025 is made absolute. The petitioner shall continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.
