The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0019 dated 10.3.2016 registered for the offences under Sections 324, 323, 506, 148 and 149 IPC and (subsequently added Section 326 IPC) at Police Station Mahilpur, District Hoshiarpur.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the petitioner is named in the FIR. He was stated to be armed with `Datar'. He gave injury though simple but on the vital part of the body i.e. front side of head. Keeping in view the above facts, I find that the petitioner is required for custodial interrogation. Therefore, in the facts and circumstances of the case, I do not find it a fit case where the present Harpal Singh Parmar 2017.02.14 16:33 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-4611 of 2017 (O&M) [2] petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
