RAJESH BHARDWAJ, J.(ORAL) Instant is the second petition filed under Section 439 Cr.P.C. praying for releasing the petitioner on interim bail in FIR No.110 dated 21.08.2019, under Sections 376/506 IPC and Section 6 of POCSO Act, registered at Police Station Nangal, District Rupnagar, due to serious medical condition of the petitioner.

Learned counsel for the petitioner submits that petitioner is diabetic and he lost his 90% eye vision.

Notice of motion.

On asking of the Court, Mr.Sandeep Kumar, DAG, Punjab, who is present in Court, accepts notice on behalf of the respondent/State and at the outset submits, on instructions from ASI Praveen Kumar, that all the prosecution witnesses already stand examined and statement under Section 313 Cr.P.C. has also been recorded and the case is fixed for 25.05.2023 for recording defence evidence.

From the above, it is clear that trial is at fag end and is likely to MEENU 2023.05.16 10:50 I attest to the accuracy and integrity of this order/judgment

CRM-M-24471-2023 -2be concluded shortly and at this stage the Court is not inclined to consider the prayer of the petitioner for grant of bail. However, the Court cannot ignore the fact that petitioner has approached this Court on account of his ill health. Hence, respondent/State is directed to get examine the petitioner from a senior doctor and provide him medical assistance as per opinion of the medical expert.
