CRM-M-4810-2016 -2Learned counsel for the complainant has referred to an affidavit (Annexure R-2/1), which was given by the complainant to the extent that she had received all the dowry articles and the criminal complaint has been filed in the Court of CJM, Sangrur that this affidavit has been forged by the petitioner.
After hearing the learned counsel for the parties, it seems that the terms of settlement have not been worked out between the parties and the question of veracity of the above-said affidavit is subject matter of trial. In view of the totality of the facts and circumstances of the case, order dated 10.02.2016, passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioner is made absolute, subject to the condition that the petitioner deposit a sum of `5 lacs in the shape of FDR in the name of complainant before the trial Court and the same shall be disbursed at the final stage, if need be. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C. Accordingly, the present petition stands disposed of.
