This petition has been filed under Section 482 Cr.P.C. for quashing of impugned order dated 23.1.2015 (Annexure-P.2) passed by learned Judicial Magistrate Ist Class, Ludhiana, in FIR No.17 dated 12.1.1996 registered for the offences under Sections 420, 467, 468, 471 and 120-B IPC at Police Station Division No.5 Ludhiana, District Ludhiana, with a further prayer to give one effective opportunity to lead prosecution evidence.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the earlier petition, bearing Criminal Misc. No.M-3663 of 2015 filed by the present petitioner challenging the same order, has already been dismissed by this Court on HARPAL SINGH PARMAR 2015.03.03 14:01 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-5970 of 2015 merit vide order dated February 5, 2015. The petitioner has again filed this petition after about 15 days by stating that in the earlier petition he could not give better particulars. This is no ground for filing the second petition. If this petition is entertained, then after some time the petitioner may again file another petition by stating that earlier he has not pleaded some facts and now again he is bringing some more facts. When the earlier petition has already been decided on merit, therefore, this second petition is not maintainable and the same is dismissed.
