Prayer made in the present petition is for quashing the order dated 23.01.2007, declining to grant of additional increment on being promoted to the post of Chief Pharmacist Grade-I.

Learned State counsel refers to preliminary objections of the written statement filed on behalf of respondent Nos.1 to 4, to which there was no replication and reads thus:

"That the case of the petitioner for granting him additional increment on the post Chief Pharmacist Grade-I is not covered under Rule 4.4 (a) (i) of Punjab C.S.R. Vol-I Part1. Wherein it has been laid down that in case any Govt employee who is appointed substantively to a post of time scale of Pay is entitled for additional increment under the provisions of this rule. In the present case the petitioner has never been appointed substantively but he has been placed in the higher scale of Rs. 6400-10640, from the post of Chief Pharmacist Grade-ll to the post of Chief Pharmacist Grade-1. Moreover the Punjab Govt vide their Memo No. 1/21/89/1HB5/91/26619 dated 1.8.91 (Annexure R-I) has specifically MOHIT 2025.05.02 17:29 I attest to the accuracy and integrity of this document

CWP-4484-2007 (O&M) -2stated that the placement from the post of Chief Pharmacist Grade-l is to be made and no promotion (increment) is to be given. As such the petitioner is not entitled for any additional increment on the post of Chief Pharmacist Grade-1." 3.
