******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.128 dated 22.10.2016 registered for the offences punishable under Sections 302 read with Section 34 of Indian Penal Code, at Police Station Jaitu, District Faridkot.
Heard.
Learned State counsel on instructions from ASI Balwinder Singh submits that petitioner has surrendered before the trial Court and has been released on interim bail as per order dated 04.12.2017. CRM-M-46131-2017 -2investigation, the petitioner was found innocent and has been summoned as additional accused to face trial on the application of prosecution filed under Section 319 Cr.P.C. His custodial interrogation is no more required during trial.
Keeping in view the above facts but without expressing any opinion on the merits of the case, this petition is allowed and order dated 04.12.2017 is made absolute, subject to the following terms:- (i) that the petitioner shall keep on appearing before trial Court regularly;
(ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave India without the prior permission of the Court;
