(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.161, dated 17.07.2014, registered at Police Station Sadar, Taran Taran, who has been booked for having committed the offence punishable under Sections 363/366 IPC (later on offence under Sections 376/342/506/120-B IPC.
As per the allegations in the F.I.R, the petitioner is paternal uncle of Shubhdeep Singh, who is alleged to have forcefully abducted the the daughter of the complainant i.e Daljit Kaur, with the help of petitioner, father and mother of Shubhdeep Singh, after alluring her with an intention to marry her.
Learned counsel further submits that before presentation of the challan, an enquiry was got conducted by DSP on 29.09.2014 and further approved by SSP in which the petitioner was found innocent. Crl. Misc. No. M-599 of 2015 (O&M) -215.08.2014 u/s 323/354/506/34 IPC has been registered at P.S. Sadar Taran Taran has been registered against the complainant and his associates who outraged the modesty and criminally intimidated the wife of brother of the petitioner. Now, the matter between the parties also stands compromise regarding the aforesaid F.I.R and the present F.I.R on 04.12.2014. CRM-M-772 of 2015 has also been filed for quashing of F.I.R and the next date of hearing is 23.04.2015.
Learned State counsel on instructions submits that the challan was presented against the petitioner on 18.10.2014. The petitioner is in custody since 20.07.2014 I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.
Keeping in view the period of incarceration of the petitioner and the fact that the matter stands compromised between the parties, this court feels that there is no need to detain the petitioners any longer, Accordingly, the present petition is allowed. Petitioners are ordered to be released on bail during pendency of the trial of the present case, subject to their furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Tarn Taran.
