Sarabjit Kaur v. Karamjit Singh
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CRM-M-6075-2014 Date of decision: 23.08.2017 Sarabjit Kaur ..... Petitioner
Versus
Karamjit Singh ..... Respondent
CORAM:
HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. Surinder Thakur, Advocate for Mr. RK Chauhan, Advocate for the petitioner.
RAMENDRA JAIN, J. (ORAL) 1.
In the instant petition under Section 482 Cr.P.C. prayer has been made for quashing Complaint No. 124/11/12 dated 20.08.2011 (Annexure P-4) under Sections 420 and 406 IPC, titled as "Karamjit Singh Vs. Ravinder Singh and others" and summoning order dated 14.10.2013 (Annexure P-5), passed by the learned Judicial Magistrate Ist Class, Hoshiarpur.
2.
This petition is lingering on since the year 2014, for effecting service of the respondent. In the last three years, the petitioner is not able to effect service upon the respondent, which amounts to wilful default. Even today, learned counsel for the petitioner prays for an adjournment for effecting service upon the respondent.
3.
Considering the overall facts and circumstances, this Court is of the considered opinion that there is no justifiable reason to grant any further adjournment to the petitioner for effecting service upon the respondent. 4.
Therefore, the instant petition stands dismissed. August 23, 2017 ( RAMENDRA JAIN ) rishu JUDGE Whether speaking/reasoned Yes/No Whether Reportable Yes/No Rishu Kataria 2017.08.24 16:23 I attest to the accuracy and authenticity of this document
