This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.59 dated 07.03.2025, initially registered under Sections 121(1), 132, 221, 3(5) and 351(2) of BNS, 2023, and later on added Section 121(2) of the BNS at Police Station Civil Lines Sonipat, District Sonipat. 2.

The case of the prosecution is that the petitioner is working as Head Constable in Delhi Police and his mother had a bank account in Central Bank of India, Model Town Branch, Sonipat. On 27.02.2025, the petitioner alongwith his mother had gone to the said Bank for withdrawal of money. In the said bank, the petitioner had an altercation with the complainant. 3.

Learned counsel for the petitioner contends that it is a case of no injury and the matter has been compromised with the complainant. He further states that he is not involved in any other case. 4.

This Court, vide order dated 30.04.2025 had directed the petitioner to appear before the Investigating Officer and join investigation and in the event Sonia Puri 2025.07.10 18:59 I attest to the accuracy and integrity of this document

CRM-M-20922-2025 -2of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

Learned State counsel on instructions states that the petitioner has joined the investigation and is not required for custodial interrogation. 6.

In view of the submissions of learned counsel for the petitioner especially when the petitioner has cooperated with the investigation, the order dated 30.04.2025 granting interim bail to the petitioner is made absolute. 7.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
