For having been found in possession of 100 grams of intoxicating powder containing Di-phenoxylate Hydrocholoride, the petitioner has been in custody w.e.f. 11.12.2015. Interim bail granted to the petitioner was cancelled on receipt of report of Chemical Examiner. Counsel for the petitioner submits that the petitioner has not misused his liberty during the interim bail period, as such, he can be granted the concession of bail.

I have considered the facts and circumstances of the case and I am of the opinion that in view of the commercial quantity of contraband having been recovered from the petitioner, no ground is made out to grant the concession of bail to the petitioner. I have considered the contention of counsel for the petitioner that till date no witness has been examined. It is directed that the trial court shall conclude the entire prosecution evidence and decide the case within a period of six months. In case, for any reason, the case is not finally decided within six months, the trial court shall release the petitioner on bail on his furnishing bail bonds/ surety bonds to its satisfaction.

Disposed of.
