The petitioner, incarcerating upon his arrest in the FIR captioned above, came up before this Court under Section 439 of Code of Criminal Procedure, 1973 (Cr.P.C) seeking bail.

Ld. Counsel for the petitioner contends that the pre-trial incarceration would cause an irreversible injustice to the petitioner and family. 4.

On 18th April 2019, Suman Kumar was kidnapped by four accused, Amandeep Singh, Devinder Singh alias Deepu, Pargat alias Pinka, and Sukhpal Singh alias Pala, for ransom. On seeing people on the roadside, Suman Kumar raised the alarm when the accused was taking him in the car to conceal him at the designated place. On this, they recorded his voice to get a ransom and killed him. After that, the accused threw the dead body and the car in the canal. CRM-M-22850-2020 complainant, which connects all four accused, namely Amandeep Singh, Devinder Singh alias Deepu, Pargat alias Pinka, and Sukhpal Singh alias Pala. These accused contacted the petitioner, related to one of the accused, Amandeep Singh to conceal their car. The investigation found a broken number plate near the canal, and police could remove the car from the car later on, even though the dead body was recovered. 6.

A perusal of the police report filed under section 173 CrPC reveals that the petitioner Pargat alias Pinka is one of the four main accused and part of the conspiracy. An analysis of the allegations and evidence collected does not warrant the grant of bail to the petitioner. Any further discussions on evidence are likely to prejudice the petitioner's case, as such this court refrains from doing so.
