Prayer in the present petition is for grant of anticipatory bail to the petitioner in a case FIR No.106 dated 17.07.2022 registered under Section 306 IPC at Police Station GRP, Ludhiana. On 12.05.2023, this Court had passed the following order:- "The present petition has been filed under Section 438 Cr.P.C is for grant of anticipatory bail to the petitioner in case FIR No.106 dated 17.07.2022, registered under Section 306 of the Indian Penal Code, 1860, at Police Station GRP, Ludhiana.

Learned counsel for the petitioner submits that the petitioner is a cousin sister of the deceased but since it's a joint family, they live in the same premises but have a separate kitchen and separate household. He further submits that the petitioner is a teacher by profession and has two small kids.

Learned State counsel, on instructions from ASI Gulab Singh, submits that there are specific allegations and instigation causing mental cruelty and harassment upon the present petitioner along with the mother-in-law of the deceased.

After hearing learned counsel for the parties and without commenting upon the merits of the case, the petitioner is directed to join investigation on 17.05.2023 at 10:00 A.M. before the Investigating Officer and cooperate with the Investigating Agency, even thereafter. In the event of arrest, the petitioner be released on interim bail subject to furnishing personal/surety bonds to the satisfaction of the Arresting/Investigating Officer and the petitioner shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. Adjourned to 02.08.2023."

Learned State Counsel, on instructions from ASI Rakesh Kumar states that in terms of the order passed by co-ordinate Bench of this Court, reproduced above, the petitioner has joined the investigation and no further interrogation is required at this stage. In view of the above, the order dated 12.05.2023 granting interim bail to the petitioner is made absolute. However, the petitioner shall abide by following conditions:- i) She shall join the investigation as and when required by the Investigating Officer.

ii) She shall not offer any threat, promise or inducement to any person acquainted with the facts of the case so as to dissuade him from

2023:PHHC:099358 Page 3 of 3 disclosing the same to the Investigating Officer/Court; and iii) She shall not leave the limits of this country without prior permission of the Court.

In case at any given point of time hereinafter, it is felt by the investigating agency that the petitioner is required for the investigation but is not cooperating, they will be at liberty to approach this Court for passing appropriate orders.
