CWP-11000-2024 (O&M) -2had sought time to file an affidavit, as observed in order dated 06.09.2023 passed by the learned Superintending Canal Officer, Loharu Water Services Circle, Bhiwani. However, despite repeated opportunities, the said order was not complied with. Ultimately, on 11.02.2025, an additional affidavit of petitioner No.1 - Chand Ram, in compliance with order dated 13.05.2024 passed by this Court, was filed by way of CM No.12024-CWP of 2024; however, in the main case, an adjournment was again sought by learned counsel for the petitioners to place on record a coloured site plan indicating the land of petitioners in relation to the existing outlet and the proposed outlet. Thereafter, the matter was adjourned on three occasions, out of which, on two occasions, there was no representation on behalf of the petitioners.

Today, learned counsel appearing for the petitioners seeks permission to withdraw the present writ petition with liberty to file fresh one with better particulars.

Such a request, after having kept the matter pending for more than a year, is totally unjustified. Be that as it may, in the interest of justice, the present writ petition is dismissed as withdrawn with liberty to file fresh one with better particulars. It is, however, made clear that any such petition shall be filed within a period of two weeks from today. 5.
