NAMIT KUMAR J. (Oral) The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to re-fix the pension of the petitioner by computing his work charge service period from 19.07.1978 to 31.12.1988, for the purpose of pension and gratuity with all the consequential benefits.
Learned counsel for the respondents submit that during the pendency of the present petition, the petitioner has unfortunately died and his legal representatives have not been brought on record. Learned counsel for the petitioner submits that she has no instructions from the legal representatives of the petitioner. In this view of the matter, the present petition is dismissed for non-prosecution.
