Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.29 dated 10.04.2018 under Sections 406, 420 IPC and Section 13 of The Professional Regulation Act, registered at Police Station Lohian, District Jalandhar. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that the main allegations as per FIR are VINEET GULATI 2018.12.05 11:58 I attest to the accuracy and authenticity of this document Chandigarh against Sunny Gill, who is son of the petitioner. As per the allegations, the

CRM No.M-47167 of 2018 -2complainant was cheated of `36,88,000/- on the pretext of second complainant party to abroad but neither they were sent abroad nor money was returned. As per the case of the complainant, as argued before this Court, `2,40,000/- has been given to present petitioner, who is father of Sunny Gill. Learned counsel for the petitioner argued that there is no allegation regarding inducement by the present petitioner. The petitioner has already joined the investigation. He is not required for investigation or custodial interrogation. Nothing is to be recovered from him. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 31.10.2018 interim bail to the petitioner, is made absolute.
