It is averred that since the time of grant of bail petitioner has been throughout appearing on each and every date, however, due to a fracture he could not appear on 11.11.2015 and an exemption was granted on an application. On the subsequent date on 1.12.2015 another application seeking exemption on the similar ground was dismissed and bail bonds cancelled and warrants of arrest issued. CRM-M 495/2016 exemption was bona fide, no proceedings were possible due to nonappearance of the summoned Pws on 1.12.2015. Further contends that in compliance of the order dated 11.1.2016 petitioner submitted himself before the trial court and was granted interim bail on 15.1.2016.
Learned State counsel on instructions from ASI Mohinder Singh does not dispute the said fact.
