R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 126 dated 23.05.2014 for offences under Sections 323, 324, 452, 307, 120-B and 506 of Indian Penal Code (IPC), Police Station Singh Tanda, District Hoshiarpur.
Learned State counsel on instructions on ASI Chanchal Singh submits that out of 17 witnesses 6 have so far been examined including the injured and other eye-witness, namely; Sukhwant Singh-complainant. These are the only two eye-witnesses.
The petitioner is in custody since 26.05.2014 and it will take some time in conclusion of the trial. In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
