(ORAL) The petitioner seeks a direction to the trial Court to decide an application dated 01.08.2022 filed under Section 311 Cr.P.C., a second application filed under Section 311 Cr.P.C. by one Gurmukh Singh and third application dated 19.04.2023 also filed under Section 311 Cr.P.C. but by the petitioner who is the complainant in a pending criminal case on the next date of hearing i.e. 15.05.2023.

At the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to approach the trial Court concerned.

The submission is accepted. Dismissed as withdrawn. No liberty, however, deserves to be granted.
