This criminal miscellaneous petition has been filed by petitioner under Section 482 Cr.P.C. for directing respondents No.2 to 4 to investigate FIR No.359 dated 13.6.2014 (Annexure-P.1) registered for the offence under Section 346 IPC at Police Station Narnaund, District Hisar in a fair, just, objective and impartial manner and further directing respondents No.3 and 4 to submit the status report in the aforesaid FIR. I have heard learned counsel for the petitioner and have gone through the record.
The petitioner only wants a direction to conduct fair and proper investigation and to submit status report in this case. As per law laid down by the Hon'ble Supreme Court in Sakiri Vasu v. State of U.P. and others, 2008 (1) RCR (Cr.) 392 (SC), the Magistrate has ample powers to supervise and monitor the investigation of the case. Cr. Misc. No.M-6121 of 2015 [2] a petition filed under Section 482 Cr.P.C. should not be entertained in routine manner by this Court and the petitioner can avail the alternative remedies.
In the present case, the petitioner can avail alternative remedies by applying to the Illaqa Magistrate.
With this direction, this petition is disposed of. February 24, 2015.
