(ORAL) Reply filed on behalf of the respondent-State is taken on record.

This is a petition that has been filed for quashing of FIR No.0189 dated 16.03.2021 registered under Sections 354-D IPC and Section 67 of the Information Technology Act at Police Station Quilla Panipat, Panipat.

Learned counsel for the petitoiner herein would contend false implication of the petitioner in the said matter. It is contended that the petitioner and respondent No.2 had solemnized marriage on 26.06.2011 and on account of a matrimonial dispute, respondent No.2 was residing at her parental home. It is further submitted that on account of proceedings initiated under Section 498-A IPC against the petitioner, he was sentenced to undergo three years imprisonment and appeal against the said judgment is pending. It is also contended that divorce proceedings have also been initiated, however, the instant FIR has been filed as a counter-blast to PANKAJ KUMAR 2021.10.28 10:26 I attest to the accuracy and integrity of this document

CRM-M No.28591of 2021 -2proceedings initiated by the petitioner under FIR No.225 dated 07.06.2020 registered under Sections 323, 325, 34, 341, 506 IPC at Police Station Quilla Panipat, District Panipat.

At this stage, learned counsel appearing on behalf of the respondent-State would submit that the matter has been investigated and the allegations levelled under FIR No.189 dated 16.03.2021 have been found to be untrue and hence, a cancellation report has been prepared. In view of the above, counsel for the petitioner does not press the instant petition, as the same has been rendered infructuous. Dismissed as having been rendered infructuous.
