Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.56 dated 13.04.2019 under Section 21 of the NDPS Act, registered at Police Station Sadar, Tarn Taran. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per prosecution version, recovery of 320 grams of heroin has been effected from co-accused Avtar Singh. The present petitioner is nominated in this case on the basis of disclosure statement of the coaccused. CRM No.M-21904 of 2019 -2that so many cases are already pending against the present petitioner and he has also been convicted earlier for 10 years in a case under NDPS Act. It has also been brought to the notice of this Court that even SSP has also written to the authorities concerned to look into the properties, which present petitioner has purchased or created with drug money. Learned State counsel also contended that so many cases have been registered against the present petitioner, his sons and other family members. Keeping in view the facts and circumstance of the present case and in view of the fact that recovery in the present case falls under commercial quantity, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.

Therefore, finding no merit in the present petition, the same is dismissed.
