*** Daya Chaudhary, J. (Oral) This petition has been moved under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.99 dated 17.05.2017 registered under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 171, 420, 467, 468 and 471 IPC at Police Station Mandi Gobindgarh, District Fatehgarh Sahib. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case whereas he was not apprehended at the spot and was arrested from his house. The petitioner is in custody since 17.05.2017 and his co-accused, namely, Bikramjit, has already been granted anticipatory bail by this court. Learned counsel also submits that the trial may take long time to conclude and no purpose would be served by keeping him in custody.

Criminal Misc. No. M-46293 of 2017 witnesses have been examined and the date fixed before the trial Court is 31.07.2018.

However, learned counsel for the petitioner submits that one witness remains to be examined and other witness is to be cross-examined. Keeping in view the submissions made by learned counsel for the parties and the stage of trial as all the prosecution witnesses have been examined except one (as stated by learned counsel for the petitioner) and the date fixed before the trial Court i.e., 31.07.2018, the trial is likely to be concluded as it is only for recording of statement of defence witnesses and arguments.

Learned counsel for the petitioner wants to withdraw this petition.

Dismissed as withdrawn.
