IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM M-5032 of 2016 Date of decision : 11.02.2016 Heera Singh & anr.

....Petitioners V/s State of Punjab & ors.

....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Ms. Anupam Bhanot, Advocate for the petitioners. RAJAN GUPTA J.

Petitioners have sought a direction to respondent no. 2 to decide representation Annexure P-1.

Apprehension of the petitioners is that they may be involved in some frivolous case at the behest of respondent no. 5. In my considered view, no case for issuance of direction for decision of the representation Annexure P-1 is made out. Such a direction would be in the nature of mandamus which this court would normally not issue in its inherent jurisdiction under section 482 Cr.P.C. As regards apprehension of the petitioners of being implicated in a false case, they shall be at liberty to avail appropriate remedy in such eventuality. Prayer made in the petition is not only vague but frivolous and the same is hereby dismissed.
