RAMESHWAR SINGH MALIK, J Petitioner, by way of instant petition filed under Section 482 Cr.P.C. seeks quashing of the Kalandra No.287 dated 27.9.2010 under Sections 182 and 211 I.P.C., Police Station Sadar, Patiala (Annexure P-1). Notice of motion was issued and status report from the learned trial court alongwith reasons for not deciding the application was sought by this court vide order dated 26.2.2015. In compliance of the above said order dated 26.2.2015, a detailed report dated 1.4.2015 has been received from the leaned Chief Judicial Magistrate, Patiala, a bare perusal of which would show that it was the petitioner, who had been delaying the matter for one or the other reason, while not appearing and repeatedly requesting for adjournments. Further, a self contained order dated 12.3.2015 passed by the learned GREESH SAHNI 2015.08.10 10:57 I attest to the accuracy and integrity of this document Chandigarh

Crl.Misc. No.M-6200 of 2015 Chief Judicial Magistrate, Patiala, would show that the application moved by the petitioner under Section 239 Cr.P.C., seeking discharge from the above said Kalandra was dismissed. In the order dated 12.3.2015 (Annexure R-1), each and every detail of the matter has been discussed and rightly appreciated by the learned Chief Judicial Magistrate, Patiala.

Learned counsel for the State submits that the prosecuting agency would lead its evidence and the matter shall be taken to its logical end without any delay on the part of the prosecution agency. Faced with the above, learned counsel for the petitioner seeks permission of the court to withdraw the present petition, with liberty to the petitioner to raise all possible pleas available to him before the learned trial court, during the course of trial.

Permission is granted.
