(ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner in case FIR No.170 dated 09.11.2017 registered under Section 174-A IPC at Police Station Kabarwala, District Sri Muktsar Sahib. Petitioner has been declared proclaimed offender vide order dated 17.10.2017 by learned Judicial Magistrate Ist Class, Malout. Consequently, aforesaid FIR has been registered against the petitoiner.
Learned counsel inter alia contends that petitioner was never served. He has wrongly been declared proclaimed offender and aforesaid FIR has also been registered against him. Having given thoughtful consideration to the submissions made by learned counsel, petitioner is relegated to the trial Court.
