(Oral) The present petition under Article 227 of the Constitution of India has been filed for issuance of appropriate orders or directions to the Family Court to expedite the proceedings in HMA-54-2018 dated 08.02.2018 titled as Vikas Dagar Vs. Yogita on the ground that the same pertains to the year 2018.

Heard.

In the present case a perusal of the file reveals that in the order dated 27.10.2021 it has been noticed that the amount of maintenance pendent lite has not been paid by the petitioner-herein. It has also been noted that the petitioner is intentionally not paying the maintenance and has been moving unnecessary applications. It further finds mentioned in the order that even reply to the application for dismissal for non-payment of maintenance pendent lite was not filed. The Court also noticed that unnecessary applications were filed by the petitioner-herein rather than paying the maintenance pendent lite. Even vide order dated 09.02.2022 the TRIPTI SAINI 2022.07.26 11:33 I attest to the accuracy and authenticity of this document

CR-2301-2022 (O&M) -2- petitioner-herein was directed to pay all dues towards maintenance pendent lite.

Today learned counsel appearing on behalf of the petitioner is not even in a position to state whether the entire amount of maintenance has been paid till date or not. There is thus no ground made out for expediting the hearing of the case pending before the Family Court. In view of the above, I do not find any ground to entertain the present petition. The same is accordingly dismissed. Pending applications, if any, also stand disposed off.
