Through the instant petition under Section 482 Cr.P.C., order dated 24.10.2017 (Annexure P-3) has been challenged by the petitioner whereby the evidence of the prosecution has been closed in view of the fact that the case pertains to the year 2014 and despite affording several opportunities, the prosecution did not conclude its evidence. 2.

The impugned order Annexure P-3 is perfectly legal and correct. However, in the interest of justice, equity and fair play, the impugned order Annexure P-3 is hereby set aside, with a direction to the trial Court to examine the Medical Officer, who has conducted medico-legal examination of the petitioner by conducting coercive methods for his summoning and appearance of other witnesses, subject to payment of ` 5000/- as costs, to be deposited with the District Legal Services Authority, Jalandhar. The instant petition is disposed of without issuing notice to the respondents with a view to impart justice expeditiously to the parties and to save the huge expenses which may be incurred by the respondents and also to avoid unnecessary delay in the adjudication of the matter. Still, if dissatisfied, the respondents may move this Court for recalling this order within a period of six weeks from today.
