The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to grant the statutory pay scale to the petitioners as per the Punjab Health and Family Welfare Technical (Group-C) Service Rules, 2016 (Annexure P-4) i.e. Rs.10300-34800 + Grade Pay of Rs.3200/- for Multipurpose Health Worker and Rs.10300-34800 + Grade Pay of Rs.4600/- for staff Nurse from entry into service along with arrears with interest @ 12% per annum and to take into account the abovesaid pay scale for further revisions and for calculating revision into 6th Punjab Pay Scale. Further, seeking issuance of a writ of certiorari for quashing the instructions dated 17.07.2020 (Annexure P-3).

Learned counsel for the petitioners submits that for redressal of their grievances, the petitioners have also served legal notice dated 11.02.2026 (Annexure P-6) to the respondents which is still pending consideration. Mr. Swapan Shorey, D.A.G., Punjab, accepts notice on behalf of the respondents-1 to 4 & 6 State. He has no objection to the innocuous prayer made by learned counsel for the petitioners. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.4 to consider and decide legal notice dated 11.02.2026 (Annexure P-6) submitted by the petitioners expeditiously, by passing a speaking order after affording an opportunity of hearing to the petitioner, preferably within a period of 03 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioners.
