RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.427 dated 17.06.2018 registered under Sections 323, 325, 326, 341, 506 and 34 IPC at Police Station Camp Palwal, District Palwal. Briefly, petitioner is facing trial in aforesaid FIR on the allegations that in the night of 15.06.2018, petitioner attacked the complainant and inflicted axe blow on right side of his head. Companions of the petitioner, namely, Deepak, Kohili, Monu and Deepak Thakur also caused injuries to the complainant with lathi and danda. Assailants kept on beating the complainant till he fell down. While leaving, assailants threatened the complainant with dire consequences. Learned counsel for the petitioner inter alia contends that petitioner is in custody since 08.07.2018. Earlier bail application was withdrawn in view of the fact that petitioner had not undergone RAVINDER SINGH 2019.01.11 10:46 I attest to the accuracy and authenticity of this document

Framing of charge and conclusion of trial may take sufficient long time in view of the fact that two FIRs have been registered against the complainant on 03.09.2018, out of which one is under Section 307 IPC and, therefore, he is absconding. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
