Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent No.1 to revise the pension of the petitioners as per the mandate of judgment passed by the Hon'ble Supreme Court in Employees Provident Fund Organization vs Sunil Kumar B. and others, AIR 2022 (SC) 5634. Further prayer has been made to direct respondent No.4 to provide the salary details of the petitioners' along with all arrears to respondent No.1 for revision of their pension on higher wage basis.

Learned counsel for the petitioners submits that he would be satisfied if the legal notice dated 12.01.2026 (Annexure P-3) of the petitioners is decided by respondents No.1 and 4 by passing a speaking order in a time bound manner.

Having heard learned counsel for the petitioners and after perusing the record of the case with his able assistance, the present petition is being decided in limine without issuing notice to the respondents in order to save judicial time of the Court and also the litigation costs of the respondents.

Keeping in view the limited prayer made by learned counsel for the petitioners, the respondents No.1 and 4 are directed to consider the legal notice dated 12.01.2026 (Annexure P-3) of the petitioners and pass a speaking order, after affording an opportunity of hearing to the petitioners, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondents No.1 and 4.
