State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Prateek Pandit,Advocate for the petitioner Jaswant Singh,J.(Oral) Prayer is for grant of anticipatory bail in case FIR No.84 dated 26.5.2014 under Sections 22/61/85 of the NDPS Act, PS Lohian, District Jalandhar.

It is averred that there was recovery of 200 grams of intoxicating powder from the person of co-accused Sukhwinder Kaur @ Sukhjinder Kaur. On her disclosure statement of having purchased the same from the present petitioner he was nominated as accused. Due to non-filing of the challan within stipulated 180 days, petitioner was granted "Default Bail" under Section 167(2) Cr.PC on 19.12.2014. Later on, owing to absence of the petitioner on 5.10.2015 and 3.11.2015 his bail bonds were cancelled and non-bailable warrants issued for 27.11.2015.

CRM-M 5075/2016 periodically admitted in Hospital for blood transfusion and therefore,unable to appear on the said dates. However, it is conceded that neither the counsel for the petitioner was informed nor any application for exemption from personal appearance moved on the said dates.

After arguing for sometime,learned counsel seeks permission to withdraw the present petition so as to enable his client to file separate petition for regular bail before the trial court in the light of his medical condition.
