Petitioner has filed the petition under Section 439 Cr.P.C. for regular bail in case FIR No.11 dated 19.1.2015, under Section 15 of NDPS Act, 1985, registered at Police Station Division No.7, District Jalandhar.
The petitioner is in custody since 19.1.2015 and case was registered for the alleged recovery of 40 kilograms of poppy husk, which falls under the non-commercial quantity. Learned counsel for the State has also placed on record the custody certificate, which is taken on record.
It be a case of non-commercial quantity, accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to regular bail subject to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jalandhar.
