JASWANT SINGH, J (Oral) Prayer is for grant of regular bail in case FIR No.103 dated 19.9.2010, under Sections 420,406,467,506,120-B IPC, Police Station Hassanpur.
Allegations are that the petitioner-accused along with non-applicants/co-accused Jagdish, Sukhbir, Jeewan Lal and Om Dev had induced the complainant-Balbir to buy 16 acres of land towards sale consideration of Rs.2,82,00,000/- by initially showing a piece of land adjacent to the main road, however, while executing the sale deed, the land included was not the same as initially shown. The petitioner is stated to be in custody since 03.11.2015 and investigation qua him is over and that nothing is to be recovered from him. That apart, it is submitted
CRM-M-509-2016 #2# that similarly placed co-accused Jagdish and Bukhbir have since been granted anticipatory bail by this Court. Learned State counsel, on instructions from ASI Ram Bir, is unable to dispute the fact qua custody period as also grant of interim bail to the similarly placed co-accused Jagdish and Sukhbir.
Without commenting upon merits of the case and keeping in view the parity and the custody period and the fact that the trial is not going to be concluded in near future, no useful purpose would be served by keeping the petitioner behind the bars any longer.
Accordingly, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Palwal. January 27, 2016 (JASWANT SINGH) manoj JUDGE
