M.M.S. BEDI, J (ORAL) Petitioner seeks quashing of FIR in a case under Section 376 IPC registered at the instance of prosecutrix ('gk'). Counsel for the petitioner has vehemently contended that an enquiry was conducted on the basis of application of wife of the petitioner to the Commissioner of Police, Ludhiana and in enquiry it was found that the prosecutrix had been living with the petitioner and moving about freely on her own free will. She had even gone abroad with him but the District Attorney having not given a favourable legal opinion in favour of the petitioner the prosecution agency was compelled to present challan.

Counsel for the petitioner, at this stage, seeks permission to withdraw the present petition Disposed of as withdrawn with liberty to the petitioner to raise all the pleas of defence raised in this petition before the trial Court at opportune time and seek benefit in accordance with law.
