(ORAL) This is a petition under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.347 dated 24.07.2020 under Section 120-B, 420 IPC and under Sections 23, 25, 3A, 4, 5(2), 6(b) of PreConception and Pre-Natal Diagnostic Technique Act, 1994 registered at Police Station Mahesh Nagar, District Ambala.

Allegations per FIR are that a raid was conducted by the teams of PNDT, Ambala and PNDT, Yamunanagar and co-accused Neeraj was arrested for illegal determination of the sex of foetus. Alleged illegal payment of Rs. 20,000/- was also recovered from him.

Learned counsel for the petitioner submits that the petitioner was not named in the FIR. He has been implicated in the present case on the basis of disclosure statement of co-accused Neeraj, who was arrested during raid. He further submits that petitioner is not involved in any other case. Even otherwise, petitioner is ready to join investigation. 4.

Having heard learned counsel for the petitioner as well as learned State counsel, this Court is of the view that keeping in view the gravity of SONU 2020.08.17 19:02 I attest to the accuracy and integrity of this document

offence and preliminary stage of investigation anticipatory bail cannot be allowed at this juncture.
