*** Petitioner Jasbir, an accused in F.I.R. No. 485 dated 22.10.2016 for offence under Section 379-A (1) of IPC registered with Police Station Sector 31, Faridabad was facing trial in the Court of Additional Sessions Judge, Faridabad. He absented from the Court without any intimation on 11.9.2017, when seven prosecution witnesses were present to get their statements recorded. Resultantly, they had to be sent back unexamined. He surrendered in the Court on 16.10.2017 and was taken into custody. He had moved an application for regular bail which was declined by the trial Court. Therefore, he has approached this Court for grant of that very relief. The request for regular bail is being opposed by the State counsel.

After hearing the rival contentions, I find that it would be proper and appropriate to grant regular bail to the petitioner though with certain conditions so that he may not absent from the Court in such a manner in future. The petition is accepted and he is ordered to be released on bail subject to his Parvinder Singh 2018.01.

CRM-M No. 46416 of 2017 furnishing personal bond and surety bond to the satisfaction of the trial Court, who may impose any term or condition in addition. The petitioner would deposit a sum of Rs.50,000/- in the trial Court. In case he absents from the Court without any intimation during the trial, the amount would stand forfeited to the State. However, if he does not indulge in any such act, the amount would be returned to him. The deposit of amount would be condition precedent for the order being effective.
