**** ANITA CHAUDHRY, J The petitioner has assailed the order dated 27.9.2017 (Annexure P-3) passed by ACJM, Kaithal vide which exemption from personal appearance was declined to him.

Petitioner is the brother-in-law of the complainant who has been challaned along with others to face trial under Section 498-A, 406, 506 IPC.

Reply has been filed by the State.

The petitioner moved an application seeking exemption till the final decision of the case and gave reasons in para No. 2 of the application. The trial Court exempted the personal appearance for that day and adjourned the case for prosecution evidence but no orders were passed with respect to the prayer made for permanent exemption.
