R.P. Nagrath, J. (Oral) CRM No. 11564 of 2015 Application is allowed and judgment dated 10.09.2014 (Annexure P-3) passed by the trial Court, is taken on record. CRM-M-6321 of 2015 Petitioner seeks bail under Section 439 Cr.P.C. in complaint/Criminal Case No. RT-12 dated 12.11.2012 institued on 25.01.2005 for offence under Sections 3(k)(i), 17, 18, 19 and 33 of the Insecticides Act, 1969, read with Section 27 (5) of the Insecticide Rule, 1971.

The petitioner remained absent for about five years after he jumped bail but ultimately arrested on 11.02.2015 and since then he is in custody.

Learned counsel for the petitioner submits that the role of the petitioner and accused no. 3, namely; Rajwinder Singh is JITENDER KUMAR 2015.04.09 17:21 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-6321 of 2015 -2same as they are secretary and salesman of the society respectively. It is further contended that proceedings before the trial Court are continuing.

In view of the above and without commenting on merits of the case and also without prejudice to the proceedings that may be initiated for forfeiture of the surety bonds, the instant petition is allowed and the petitioner be admitted to bail on furnishing fresh bail bonds to the satisfaction of the trial Court. Allowed in the above terms.
