This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 6 dated 27.01.2015 under Sections 409 read with section 420 IPC at Police Station Nurmahal, District Jalandhar. Learned counsel for the petitioner submits that petitioner is not guilty of any offence. He has been falsely implicated in the case.
Learned State counsel has refuted the plea. According to him, `10,20,000/- were transferred at the behest of Palwinder Singh from government treasury to account of the petitioner. Entire money has been withdrawn from the said account. He, on instructions from SI Jagdish Singh, who is present in court, submits that custodial interrogation of the petitioner is necessary. I have heard learned counsel for the parties. In my considered view, allegations against the petitioner are serious. Written complaint was made by Principal of Govt. CRM M-6332 of 2015 Senior Secondary School, Cheema Kalan, Tehsil Phillaur alleging that heavy amount had been withdrawn from the treasury in the names of some bogus employees. Said amount had been embezzled. In my considered view, custodial interrogation of the petitioner in such a case is necessary. Petition is without any merit and is hereby dismissed.
